Carol G. Dell is as steadfast in promoting her clients’ positions in negotiations, court proceedings, and formal hearings as she is meticulous in preparing the legal documents, plan documents, and motions to support them. She is committed to advising clients of the constantly changing and evolving laws and regulations that affect clients.

Ms. Dell works with union, governmental, and multi-employer pension and benefit plans. She also serves as counsel to a number of unions and related Taft-Hartley and governmental funds. Ms. Dell represents collective bargaining units and their associated benefit funds in various labor law matters, as well as employment law matters.

Ms. Dell’s clients retain and rely on her to:

• Monitor and enforce ERISA requirements.
• Advise on compliance matters involving multi-employer benefit plans, public sector benefit plans, retirement plans [(Defined Contribution (DC) and Defined Benefit (DB)], and Welfare Plans.
• Form and structure benefit plans.
• Provide representation in arbitrations, grievance mediations and hearings, administrative proceedings and litigation involving unions and benefit funds.
• Provide representation in ERISA litigation and collection actions.
• Represent fund trustees in ERISA and other fiduciary matters.
• Advise on Withdrawal Liability matters.
• Negotiate collective bargaining agreements on behalf of unions (private sector and public sector).
• Provide representation in NLRB, EEOC and NY Human Rights Division proceedings concerning duty of fair representation issues, elections, employment discrimination claims and unfair labor practices claims.
• Advocate in Bankruptcy actions in which her clients are creditors.
