Lawrence Finnell is Of Counsel in the Firm's Employee Benefits practice group. Mr. Finnell's practice centers on the design, drafting, implementation, operation, and administration of tax-qualified benefit plans, multiemployer plans, nonqualified deferred compensation plans, cafeteria plans, executive and equity compensation programs, and health & welfare benefit plans. Mr. Finnell counsels clients on a variety of employee benefits law issues pertaining to plan qualification, fiduciary duties, prohibited transactions, funding concerns, mergers and acquisitions and other corporate transactions, plan investment guidelines, employment contracts, claims and appeals procedures and dispute resolution, executive compensation, government audits, and equity-based compensation. He offers advice on day-to-day administrative matters concerning eligibility, participation, fiduciary concerns, and tax issues relating to plan contributions and distributions, as well as assists with government audits, and participant communications.

Mr. Finnell is familiar with all types of defined contribution retirement plans, profit-sharing plans, defined benefit plans, ESOP's, stock purchase plans, stock option plans, cafeteria plans, health plans, retiree health plans, severance plans, and a number of welfare plans including adoption assistance, tuition reimbursement, flexible spending, and dependent care, among others, as well as plans for tax-exempt organizations and churches.

He counsels clients with respect to interpretation of and compliance with the Internal Revenue Code, Treasury Regulations, ERISA, securities laws, and other applicable federal and state laws including but not limited to COBRA, HIPAA/HITECH, DOMA, USERRA, and the Affordable Care Act. Mr. Finnell prepares and documents plan corrections including IRS EPCRS and DOL VFCP submissions, drafts plan amendments, prepares and files IRS Determination Letters, handles issues concerning plan termination and location of missing participants, and addresses a number of other issues concerning qualified separate lines of business, withdrawal liability, Code Section 409A, among others.

Prior to joining the Firm, Mr. Finnell was an associate at McCarter & English LLP in their Tax and Benefits practice group and another labor and benefits law firm in New Jersey. Prior thereto, Mr. Finnell served as judicial law clerk to the Honorable Mark A. Sullivan, Jr. in the Law Division of New Jersey Superior Court, Monmouth Vicinage.

Mr. Finnell has also been recognized as a New Jersey Rising Star for 2013-2014.

Mr. Finnell received his Bachelor of Science from The College of New Jersey in 2001, his Juris Doctor from Suffolk University Law School in 2004, and his Legum Magister in Taxation from Villanova University School of Law in 2012. He is a member of the state bars for New Jersey and New York, as well as the bar for the United States District Court for the District of New Jersey.
